THE PILATES DIFFERENCE – CLIENT WAIVER & INDEMNITY
1. ACKNOWLEDGEMENT OF RISK
I acknowledge that participation in Pilates and related fitness activities involves physical exertion and carries inherent risks, including but not limited to muscle strain, injury, or other health complications. I voluntarily choose to participate in all sessions offered by The Pilates Difference.
2. MEDICAL DECLARATION
I confirm that I am in good physical condition and able to participate in exercise. I will inform the instructor prior to any session of any medical conditions, injuries, pregnancy, or other concerns that may affect my ability to exercise safely.
I understand that it is my responsibility to consult with a medical professional prior to participating if I have any concerns about my health.
3. ASSUMPTION OF RISK
I accept full responsibility for any risks, injuries, or damages, known or unknown, that I may incur as a result of participating in classes or using the Studio’s facilities.
4. RELEASE OF LIABILITY
I hereby waive, release, and discharge The Pilates Difference, its owners, instructors, employees, and contractors from any and all claims, liabilities, or demands arising from injury, loss, or damage incurred during participation, except where such liability cannot be excluded under South African law.
5. INDEMNITY
I agree to indemnify and hold harmless The Pilates Difference and its representatives against any claims, damages, or expenses (including legal costs) arising from my participation in activities or breach of these terms.
6. PERSONAL PROPERTY
I understand that I am responsible for my personal belongings and that the Studio is not liable for any loss, theft, or damage.
7. CONSENT TO INSTRUCTION
I consent to physical adjustments or verbal instruction where necessary to ensure correct technique and safety, unless I expressly decline such contact.
8. GOVERNING LAW
This waiver shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
